First, can a 45 foot Provincial commercial fish in U.S. waters? Second, can a Provincial 45 charter in U.S. waters?

You can't document it, so if you have some sort of fishery that requires your vessel to be documented, then you're SOL on that front.


Now if you stash some hash on board, get the boat impounded and buy it through an auction by the US Marshal Service then you can get it documented. Or rebuild it over 66% (or something like that) of it's cost you can do that that way too (seems extreme for a novi...) there are a few different ways around the Jones Act as far as documentation goes, heck if you luck out and have it become a War Trophy you could be all set.

Commercial fishing part would be lobster and/or crab. Would that require a federal register?

Actually it's yes and yes now.
The first being trickier than the second.

1. Commercial fishing requires that you be under 5 tons and only be state registered. Talk to a surveyor. There are a ton of big 45' novis running like this.

2. You can run charters with up to twelve passengers with the small vessel waiver program. You still need a COI for over 6.

Yes you can, agreed. The catch is they HAVE to be documented COASTWISE!

If the boat is foreign built (ie a Novie Boat) you need to document it. You can document it RCREATIONAL but you can not charter it. Because of the Jones Act you need to petition for an expemtion!
